Terms for the beta.

What you are agreeing to, what we are promising, and, more usefully, what we are not.

Draft, not yet in force. This describes what the software actually does today, written from the code rather than from a template. It still needs three things before it can be published: the legal entity that operates Orza, a contact address, and a read by someone qualified. Every place one of those is missing is marked [LIKE THIS].
Section 01

The agreement

Between you and us

These terms are between you and [LEGAL ENTITY NAME] of [REGISTERED ADDRESS] ("we", "us"). By creating an account you accept them. If you do not, do not create one.

It is free, and there is nothing to buy

The beta costs nothing. We take no payment details, there is no subscription, no trial that converts, and no tier you can be upgraded into. If that ever changes we will tell you before it does, and you will have to agree to it separately.

Who can use it

You must be 18 or over, and you must either own the battery system you connect or be authorised by its owner to connect it. You will need an account with your battery manufacturer, and their terms continue to apply to it.

Section 02

What the service does

It reads, and it is read-only

Orza reads your battery system through your manufacturer's cloud API, builds a 48-hour plan against electricity prices and a solar forecast, and shows you what that plan would have been worth against what your system actually did.

It does not control your battery. In Watch mode, the only mode offered during this beta, Orza sends your system no instructions of any kind. Your battery does exactly what your manufacturer's app tells it to, before and after you sign up.

If control is ever offered

It will be opt-in, separately, and on terms you are shown at the time. Nothing in these terms permits us to operate your equipment.

We install nothing

There is no hardware, no hub and no software on your home network. If your manufacturer has no usable cloud API, we cannot reach your battery and we will tell you so.

Section 03

What we do not promise

We do not promise you will save money

Any figure we publish is evidence, not a forecast of your result. Where we quote a saving we say what it was measured on and what it was measured against. The £334 to £427 a year on our home page is a backtest of one house's metered consumption over 359 days against a fixed overnight charging window, and it varies by hundreds of pounds with what you are paid for export alone. Your house, tariff, battery, roof and habits are all different.

It is not advice

Nothing in the product or on this site is financial advice, investment advice, or a recommendation about which electricity tariff or equipment to buy. We are not regulated to give any of those. Decisions about your tariff and your equipment are yours.

We do not promise the data is complete

We depend on your manufacturer's cloud, your supplier's API and a weather forecast, and any of them can be unavailable. When that happens the gap is shown as a gap: a half hour we could not read is marked missing and the day it belongs to is left out of your savings figure. We would rather show you a hole than fill it in.

We do not promise it will always be up

There is no uptime commitment during the beta. Because the service is read-only, an outage costs you visibility, not electricity.

Section 04

Your side of it

Accurate details

The plan is only as good as what you tell us about the house. If your battery capacity, tariff or export rate is wrong, the figures will be wrong, and that is not a fault in the service.

Your account

Keep your password to yourself and tell us if you think someone else has it. You are responsible for what is done through your account.

Fair use

Do not attempt to reach other people's data, break or overload the service, scrape it at volume, or use it to build a competing product from our data rather than your own. Do not connect a system you have no right to connect.

Who owns what

The software, the site and everything in them stay ours. Your data stays yours: connecting your system gives us permission to read it and to process it in order to provide the service, as set out in the privacy notice, and nothing more. If you send us feedback we may act on it without owing you anything for it.

Other people's services

We are independent of, and not endorsed by, any battery manufacturer or electricity supplier. Your agreements with them are unaffected by this one, and we are not responsible for what their services do, charge or change.

Section 05

It is a beta, and we mean it

What that means in practice

Features will change and some will be withdrawn. Things will break. We may need to recompute history when we fix a bug in how a figure was scored, so a number you saw last week can legitimately change; when that happens it is because the old one was wrong.

Keep your own records if they matter

Do not rely on Orza as your only record of anything you need. We take reasonable care, but this is a beta and we do not offer a data retention guarantee during it.

Section 06

Liability

What we do not limit

Nothing here excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, your statutory rights are not affected by anything in these terms.

What we do limit

Otherwise, and to the extent the law allows: the service is provided as it is, for a free beta, and we are not liable for lost savings, lost profit, higher energy bills, or decisions you took in reliance on a figure we showed you. [CONFIRM THE LIABILITY CAP AND ITS WORDING WITH A SOLICITOR: a free service with no fee has no natural cap, and consumer law limits what can be excluded.]

Law and courts

These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you live elsewhere in the UK you keep the right to bring proceedings in your own courts.

Section 07

Ending it

You can leave whenever you like

Delete your account in the app. That removes your data as described in the privacy notice. You can also just disconnect your manufacturer account, which stops us reading anything.

We can end the beta

We may suspend or close an account that breaks these terms, and we may end the beta itself. If we close the beta we will give reasonable notice and time to get your data out first, except where a serious breach or a legal obligation makes that impossible.

Changes to these terms

We will tell you about a change that matters rather than re-dating this page quietly, and you can leave if you do not accept it. Last updated: [DATE ON PUBLICATION].
